Compañeras and compañeros

The women and men of the pueblo of San Sebastian Bachajon greet all the peoples and communities in resistance who defend their territories against the projects of dispossession of the bad government. We greet and send all our solidarity to the families and compañeros of the 43 missing normal school students of Ayotzinapa disappeared by the bad government since September 26, 2014, and demand their immediate presentation alive.

We inform you that on 29 September last, for the third time we succeeded in overturning the decision of the Seventh District Judge of Tuxtla Gutierrez in judgement 274/2011 which did not recognise our right as ejidatarios to defend our territory, despite demonstrating that the ejidal commissioner Alejandro Moreno Gomez and the former ejidal commissioner Francisco Jimenez Guzman aka Goyito are accomplices of the bad government because they gave away the lands illegally and allow the police to be stationed on our territory without authorization from the highest body of the ejido.

On 29th September the third collegiate tribunal in Tuxtla Gutierrez resolved our appeal number 224/2014 in a review which says that the ruling of the seventh judge is incorrect and that our demand is indeed valid, because our organization along with compañero Mariano Moreno Guzman submitted our petition in compliance with the requirements of the law and also because the officialist ejidal commissioner never did anything to defend the lands of the ejido, when this situation happens every ejidatario can file their claim. Also the third collegiate tribunal, on the grounds that the violations of our rights as indigenous people are very serious, took the decision to send our amparo to Mexico city so that the supreme court of justice of the nation can consider whether or not it can resolve the case, in the next few weeks it will give its response. The case is turned over to the Minister Margarita Luna Ramos to present a draft consideration of the case for 12thNovember. We will be awaiting the decision of the supreme court as to whether it will consider the case or return it to the third collegiate tribunal, and we will continue fighting to regain our land.

Our compañeros the political prisoners JUAN ANTONIO GOMEZ SILVANO, MARIO AGUILAR SILVANO and ROBERTO GOMEZ HERNANDEZ, who were tortured by the bad government and have been deprived of their freedom unjustly since 16th September, 2014 for fighting for justice and the defence of their territory, were transferred on 2nd October to prison number 12 Yajalón, Chiapas, where they remain unjustly imprisoned for crimes they did not commit which were fabricated by the Chilón municipal police, in revenge for the imprisonment which our community, Virgen de Dolores, achieved for their compañero Sebastián Méndez Hernández, who is a prisoner in El Amate for the murder of the compañero and former co-ordinator Juan Carlos Gómez Silvano. On October 24, the proceedings were admitted for the amparo against the detention order made by the mixed judge of Ocosingo, Lic. Omar Helería Reyes, dated September 24, 2014, for the crime of attempted murder. We demand their immediate release because the crimes are fabricated and the proofs are illegal. The judge from Ocosingo only took into account the statement by the commander of the municipal police from Chilón and two of his officers for making the detention order.

We also demand the release of our compañero SANTIAGO MORENO PEREZ who has been imprisoned since 2009 in the prison of Playas de Catazajá on the accusation of priistas from the community of La Pimienta, because at the time he was arrested he held the position of autonomous vigilance councillor for the other campaign, and they blamed him for a crime he did not commit in order to remove him from office. Our compañeroEMILIO JIMENEZ GOMEZ, imprisoned since July 2014 also in Playas de Catazajá, was identified by the community of Xanil as having assaulted a foreigner, but this same foreigner said the compañero was not the person who assaulted him, but the priistas took him as a prisoner to Playas de Catazajá with the complicity of the state preventive police. Our compañero ESTEBAN GOMEZ JIMENEZ, imprisoned since 2013 in Playas de Catazajá and then transferred to El Amate, was accused by the member of the green ecologist party Manuel Jiménez Moreno from the community of Pamalha of an assault he did not commit, which is why he was first arrested, and then once arrested they began to accuse him of other crimes.

We express our total rejection of the megaprojects which are dispossessing the peoples of Chiapas and throughout the country, for which reason we offer our total solidarity to the compañeros and compañeras of the ejido Tila, Los Llanos, Candelaria, San Francisco Xochicuautla, the Yaqui Tribe and all the peoples who are resisting jail, death and repression from the bad government, we tell them to keep fighting because they are not alone.

We demand that the bad government and the officialist ejidal commissioner of San Sebastián Bachajón, Alejandro Moreno Gómez, do not continue robbing our people of their territory and natural resources, because the people will continue defending them.

From the northern zone of the state of Chiapas the women and men of San Sebastián Bachajón send our combative greetings.
