On November 12, the Supreme Court decides whether or not it will consider the case of the ejido San Sebastián B achajón
Bachajón Chiapas, Mexico, November 4th. “Taking the view that the violations of our rights as indigenous people are very serious, the third appellate court in Tuxtla Gutierrez has taken the decision to send our amparo to the city of Mexico, so that the Supreme Court can consider whether or not they can resolve the case,” reports the ejido San Sebastián Bachajón, of Chilón, Chiapas.
The case is turned over to the Minister Margarita Luna Ramos, who will present a draft consideration of the case for November 12. “We are waiting for the decision of the supreme court as to whether they will consider the case or return it to the third collegiate tribunal, and we will continue to fight to regain our land,” say the Tseltal indigenous.
The ejidatarios, adherents to the Sixth Declaration of the Lacandon Jungle, also pronounced for the freedom of their imprisoned compañeros: JUAN ANTONIO GOMEZ SILVANO, MARIO AGUILAR SILVANO and ROBERTO GOMEZ HERNANDEZ, “who were tortured by the bad government and have been unjustly deprived of their liberty since 16th September, 2014, for fighting for justice and the defence of their territory,” they state.
“They were taken on 2nd October to prison number 12 in Yajalón, Chiapas, where they remain unjustly imprisoned for crimes they did not commit and which were fabricated by the municipal police of Chilón, in revenge for the imprisonment which our community, Virgen de Dolores, achieved for their compañero Sebastián Méndez Hernández, who is a prisoner in El Amate for the murder of the compañero and former co-ordinator Juan Carlos Gómez Silvano,” explain the organized campesinos.
“On October 24, the proceedings were admitted for the amparo against the detention order made by the mixed judge of Ocosingo, Lic. Omar Helería Reyes, dated September 24, 2014, for the crime of attempted murder. We demand their immediate release because the crimes are fabricated and the proofs are illegal. The judge from Ocosingo only took into account the statement by the commander of the municipal police from Chilón and two of his officers for making the detention order,” say the complainants.
The ejidatarios are also demanding the release of their compañeros SANTIAGO MORENO PEREZ who has been imprisoned since 2009 in the prison of Playas de Catazajá; EMILIO JIMENEZ GOMEZ imprisoned since July 2014 also in Playas de Catazajá; and of ESTEBAN GOMEZ JIMENEZ, imprisoned since 2013 in Playas de Catazajá and then transferred to the prison of El Amate, in the central part of the state.
“We express our total rejection of the megaprojects which are dispossessing the peoples of Chiapas and throughout the country, for which reason we offer our total solidarity to the compañeros and compañeras of the ejido Tila, Los Llanos, Candelaria, San Francisco Xochicuautla, the Yaqui Tribe and all the peoples who are resisting jail, death and repression from the bad government, we tell them to keep fighting because they are not alone,” says the ejido of San Sebastián.
